Terms of Use - MyTwin Lab

These Terms of Use (the "Terms") govern access to and use of MyTwin Lab. Please read them carefully: by signing in, you accept them.

1. Legal notice

MyTwin Lab, available at https://mytwinlab.care, is published by We Are One, a French simplified joint-stock company (SAS) registered with the Trade and Companies Register under number 953 111 960, whose registered office is located at 10 Rue de Penthièvre, 75008 Paris, France.

2. Definitions

  • Lab: the MyTwin Lab platform and all its pages and features.
  • Visitor: anyone browsing the public pages of the Lab without an account.
  • Member: a person who has signed in to the Lab.
  • Challenge: a health-related problem published in the Lab. An official challenge is defined by MyTwin; a validation challenge checks that a deliverable produced in another challenge works.
  • Sandbox project: a project proposed by a member in the Sandbox.
  • Contribution: anything a member submits to the Lab, such as code, commits, pull requests, datasets, models, documentation, Sandbox projects, reference cases, observations, verdicts or discussion messages.
  • Contribution points (CP): the points credited for contributions and shown on the leaderboard.
  • MyTwin Platform: the MyTwin health platform, presented at mytwin.care, for which the Lab explores and builds new applications.

3. Purpose of the Lab

MyTwin Lab is the open innovation platform of MyTwin: a collaborative research and development environment where clinicians, researchers, engineers, students and healthcare organizations work together on health challenges. Members can take part in challenges, launch and support Sandbox projects, and have their contributions evaluated, credited with CP and shown on a public leaderboard.

The Lab is a separate service from the MyTwin application, whose own terms are available at https://mytwin.care/en/terms-of-use.

The Lab is free of charge. It is provided in beta: features may evolve, be added, limited or removed.

4. Research and prototyping only

Not a medical device

The Lab is not a medical device within the meaning of Regulation (EU) 2017/745 or equivalent legislation in other jurisdictions, and neither is anything produced in it: code, models, datasets, applications, evaluations, scores or verdicts.

The Lab does not provide any medical diagnosis, prognosis or treatment, and does not replace the advice of a healthcare professional.

Prototypes, not validated products

Work produced in the Lab is experimental. Evaluations, scores, CP and validation verdicts measure a contribution against the criteria of a challenge; they are not a clinical, scientific or regulatory validation.

Before an application built in the Lab is integrated into the MyTwin Platform or used in any clinical setting, it must go through its own validation, regulatory and ethical process.

No use on real patients

Deliverables from the Lab must not be used to make decisions about the health of a real person.

Emergencies

The Lab is not a health or emergency service. In the event of symptoms, an emergency or a medical question, contact a healthcare professional or call 15 (SAMU), 112 (European emergency number) or the emergency number of your country.

5. Acceptance and changes to the Terms

You accept these Terms when you sign in to the Lab. Visitors are bound by the provisions that apply to them.

We may update these Terms, in particular to reflect changes to the Lab or to the law. Members will be informed of any substantial change at least 15 days before it takes effect, on the Lab or by email. If you do not accept the new Terms, you may close your account at any time before they take effect; continuing to use the Lab afterwards means you accept them.

The current version of these Terms is always available at https://mytwinlab.care/terms-of-use, with its date of last update.

6. Accounts

Public pages (challenges, Sandbox, leaderboard) can be browsed without an account. Taking part in the Lab requires signing in with a Google account.

To create an account, you must be at least 18 years old.

Your account is personal and must not be shared. You agree to provide accurate information (in particular your name and GitHub username), not to impersonate anyone, and to hold only one account. You are responsible for the activity carried out through your account, and must tell us without delay if you suspect unauthorized use.

Some members are given a specific role by MyTwin, such as project manager or medical professional. A member who accepts the medical professional role confirms that they hold the qualification they declared, and acts within the Lab under their own professional responsibility. MyTwin may ask for proof of that qualification and withdraw the role at any time.

7. Health data and confidential information

This rule applies to everything put into the Lab: repositories, datasets, models, reference cases, files, Sandbox projects, messages and comments.

You must never upload, submit, link to or process in the Lab:

  • personal health data, or any data relating to an identified or identifiable patient;
  • data covered by medical confidentiality, or that you are not authorized to share;
  • confidential information belonging to a healthcare institution or any third party, without its authorization.

Only public data used under a compatible license, properly anonymized data, or synthetic data may be used.

The Lab is not hosted by a certified health data host (HDS) and is not designed to store health data. Any content breaching this rule will be removed (see § 11).

A healthcare organization that provides material for a challenge remains responsible for ensuring that it can lawfully be shared, and for obtaining its own internal approvals. The terms of such a collaboration may be set out in a separate agreement with We Are One.

8. Contributions

Your commitments

By submitting a contribution, you guarantee that:

  • you are its author, or hold the rights needed to submit it;
  • it respects the licenses of the code, datasets and models it relies on;
  • it contains no malicious code, no secrets or credentials, and no unlawful content or content infringing the rights of others;
  • it does not reuse the work of another member without credit.

Intellectual property of contributions

You keep the rights you hold on your contributions, subject to the licenses below.

Official and validation challenges. By submitting a contribution to an official or validation challenge, including in a repository or branch provided by MyTwin, you grant We Are One a non-exclusive, worldwide, royalty-free, transferable and sublicensable license, for the full legal duration of the rights, to use, reproduce, represent, adapt, modify, translate, integrate, distribute and exploit that contribution, in any form and on any medium, including commercially and within the MyTwin Platform and MyTwin's other products and services. When a challenge or its repository specifies an open-source license, that license also applies.

Sandbox projects. A Sandbox project remains the property of its author. By publishing it, the author allows We Are One to display it, evaluate it and promote it within the Lab and in MyTwin's communications. Contributions made by other members to a Sandbox project are governed by the license the author chose for the project's repository; authors are encouraged to choose one when they create the project. If a project is promoted into an official challenge, the work carried over at promotion and all later contributions fall under the rules of official challenges.

These licenses do not affect authors' moral rights. Members are credited for their contributions on the Lab.

Lab content

The components of the Lab (name, logo, interface, texts, evaluation grids, design, etc.) are protected by intellectual property law and belong to We Are One. Any reproduction or exploitation without prior written authorization is prohibited.

9. Evaluation and contribution points

Contributions are evaluated in part automatically: by AI agents scoring them against the published grid of a challenge, by measurable metrics for machine-learning models, by star milestones for Sandbox projects, and by the detection of contributions in the discussion channels of a challenge. How contributions are assessed is described on each challenge.

These evaluations can be imperfect. You can ask for a human review of any evaluation concerning you (see § 16).

Contribution points have no monetary value. They are not money, cannot be converted, exchanged, sold or transferred, and give no right to any payment, remuneration or employment. Any other form of reward would be governed by specific rules published separately.

CP may be corrected or withdrawn in the event of error, fraud or abuse (for example fake accounts, coordinated starring or manipulation of evaluations). Rankings change accordingly, and ranking rules may evolve.

10. Acceptable use

When using the Lab, you must not:

  • post unlawful, discriminatory, harassing, defamatory or misleading content;
  • attempt to access data, accounts or features you are not authorized to use, or disrupt the Lab (report security issues to us instead);
  • collect the personal data of other members, in particular by automated means;
  • create accounts automatically or on behalf of others;
  • present work produced in the Lab as clinically validated, or as endorsed by MyTwin or by a healthcare organization, without written authorization;
  • use a temporary GPU instance for anything other than the work of its challenge (for example cryptocurrency mining);
  • collect or keep the personal data of members who test an application or API you expose for a validation challenge, beyond what the test requires.

The Lab relies on third-party services (Google, GitHub, Kaggle, Slack, and the platforms where members deploy their applications), whose use is governed by their own terms. GPU instances are temporary and are destroyed with their content when they expire: saving your work is your responsibility.

11. Reporting content and moderation

Reporting

Anyone can report content they consider unlawful or contrary to these Terms by writing to contact@my-twin.io, with the link to the content, the reasons for the report, and their contact details. We process reports diligently and inform the person who reported the content of the decision taken.

Measures

When content or behaviour breaches the law or these Terms, we may, in proportion to the breach: remove or restrict the content, withdraw CP, withdraw a role, or suspend or close the account concerned. Moderation decisions are taken by members of the MyTwin team; no automated system decides on them.

Except in urgent cases (for example the presence of health data, a security risk or unlawful content), the member is informed beforehand. In all cases, the member receives a statement of the reasons for the decision.

Contesting a decision

A member can contest a moderation decision by writing to contact@my-twin.io within six months. The request is reviewed by a person other than the one who took the initial decision, where possible.

Point of contact

The single point of contact for members and for authorities, including under the EU Digital Services Act, is contact@my-twin.io. Requests can be written in English or in French.

12. Closing your account

You can close your account at any time by writing to contact@my-twin.io. Account closure is carried out as described in the Privacy Policy.

The licenses granted on contributions (§ 8) survive the closure of the account, so that work already integrated into challenges remains usable.

13. Liability

We Are One strives to keep the Lab available and reliable. As the Lab is provided free of charge and in beta, We Are One does not guarantee:

  • uninterrupted and error-free access;
  • the accuracy of evaluations, scores and rankings;
  • the quality, safety or fitness for any purpose of the work produced by members.

You are responsible for your contributions and for the use you make of the work of others.

Within the limits allowed by law, We Are One shall not be liable for indirect damages resulting from the use of the Lab. Nothing in these Terms limits liability for gross negligence or intentional misconduct, for death or personal injury, or the rights consumers hold under mandatory law.

14. Personal data

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and French data protection law, as described in the Privacy Policy.

15. General provisions

If a provision of these Terms is held invalid, the other provisions remain in force. Failing to enforce a provision at a given time is not a waiver of it. These Terms, together with any separate agreement signed with a healthcare organization, form the entire agreement on the use of the Lab.

17. Governing law and disputes

These Terms are governed by French law.

In the event of a dispute, please contact us first, so that we can look for an amicable solution. Failing that, the dispute will be brought before the competent French courts. If you are a professional, the courts of Paris shall have exclusive jurisdiction. If you are a consumer, you may also bring the case before the court of your place of residence, and you retain the protection of the mandatory provisions of the law of your country of residence.
